Based on the factual data obtained as a result of large-scale investigative and other procedural actions carried out within the framework of the criminal case under investigation, in particular, in the Military Investigation Department of the RA Investigative Committee, it was established that on November 16, 2021. at 11:30, Azerbaijani servicemen launched an attack in the direction of three Armenian positions in the Ishkhanasar sector of the Kilisaly border in the Syunik region. During this, the person in charge of position N, the senior in position N and two sentinels, who were on combat duty, violated the combat regulations and the rules of combat duty, approved by the corresponding order of the RA Minister of Defense.
In particular, having learned about the approach of the enemy, the servicemen, who had the authority to use weapons, instead of neutralizing and disarming the enemy, tried to enter into negotiations with him.
The Azerbaijani soldiers attacked the combat position, trying to capture the personnel on alert. Instead of carrying out these actions, the personnel left their combat positions and fled, after which the servicemen of the Azerbaijani Armed Forces entered the sovereign territory of the Republic of Armenia and took control of the Armenian positions. Another 24 servicemen of the Armed Forces of Armenia were surrounded and captured.
The bodies of the dead Gurgen Ashotovich Sargsyan, Artur Dzhivanovich Martirosyan and David Gelbertovich Amiryan on November 17 and 20, 2021. were transferred to the Armenian side. Seven servicemen (including 4 mentioned above) on November 26 and December 4 of this year were returned to the Armenian side. The whereabouts of 14 servicemen are still unknown.
Lieutenant S.A., responsible for the indicated combat position N on December 6, 2021, senior in position N, junior sergeant A.A., patrolmen R.N. and AM were detained on suspicion of violating part 3 of Article 365 of the RA Criminal Code (violation of the rules of combat duty or military service, which entailed grave consequences).
On December 8, they were charged under part 3 of Article 365 of the RA Criminal Code, and a petition was submitted to the court of general jurisdiction of the city of Yerevan to use detention as a preventive measure. The petition was granted by the court.
In addition, as a result of large-scale investigative and other procedural actions carried out during the preliminary investigation of the same criminal case, it turned out that the deputy battalion commander for moral and psychological support of military unit N of the RA Ministry of Defense, Major N.Ye. violated the rules established by the RA Law “On Approval of the Charter of the Internal Service of the Armed Forces of the Republic of Armenia”, approved by the decree on the organization and maintenance of combat duty and the corresponding order of the RA Minister of Defense, as a result of which these actions entailed serious consequences.
The servicemen of the Armed Forces of Azerbaijan invaded the sovereign territory of the Republic of Armenia – into a combat position, the remaining 13 servicemen were captured by the enemy, and the combat position came under the control of the enemy. The bodies of Taron Jivanovich Sahakyan, Arsen Senikovich Gasparyan (from among the captured military personnel) were handed over to the Armenian side on November 17 and 19, respectively. December 4 this year 4 servicemen (including Major N.E.). returned by Azerbaijan to the Armenian side. The whereabouts of the remaining 7 servicemen are still unknown.
December 6, 2021 Major N.E. was arrested on charges under Part 3 of Art. 365 of the RA Criminal Code. A petition to change the preventive measure was submitted to the Yerevan Court of General Jurisdiction, and it was rejected by the court. The court’s decision was sent to the prosecutor in charge of the preliminary investigation process – with a request to consider the expediency of filing an appeal.
Recall that the acting. the battalion commander responsible for the protection of the same military unit and the patrol of combat position N, charged under Part 3 of Art. 365 of the RA Criminal Code, arrest was applied as a precautionary measure.
An investigation is underway.
The body conducting the proceedings considers it necessary to present to the public the heroism of the Armenian servicemen, who showed exceptional courage in the performance of their duties during the indicated hostilities.
In particular, on November 16, 2021, Private Gurgen Ashotovich Sargsyan, a contract soldier serving in the indicated combat position located on the Ishkhanasar section of the Kilisali line of the Syunik region, did not surrender to the enemy, showed a rare fighting spirit, exceptional courage and blew himself up with a grenade.
